Uniform Civil Code mentioned in Article 44 of our Indian constitution in part 4 Directive Principles of State Policies. Article 44 of our Indian constitution defines that state shall endeavour to secure for all citizens a Civil Code that is uniform throughout territory of India.

Basically, UCC is a set of some personal laws which a citizen of India shall abide by irrespective of caste, religion or any community. Till now Goa is only state which has adopted Uniform Civil Code and has implemented it too.

Uniform Civil Code – Public Notice

Law commission of India was formed in 1955, which is a statutory body who advices the government on its legal matters. This law commission advised the Indian government for uniform civil code in 1983 and from then till now it debate over it whether to adopt UCC or not is going on. Currently its 22nd law commission of India and in 2024 this commission is seeking suggestions regarding UCC from the stakeholders.

As per reports a census was being conducted in 2019 for Indians and according to its report only 62% of the Indians were in favour of UCC. After this long period of debate and yet no conclusion so far, public consultation is now a method that will provide a valuable perception for this long debate to move forward.

All proponents involved in UCC have an opinion that implementation of UCC will promote social justice and gender equality. They argue that the current personal law system treats women on the basis of their gender and religion which leads to discrimination. Hence the adoption of a uniform civil code will help in creating more steadiness and consistency towards our legal framework.

But all those who are criticising the implementation of UCC have an opinion that it would violate and transgress upon the religious freedom of our citizens. They think that the adoption of UCC might take away the cultural and religious rights of other minorities. Hence now the law commission is seeking for public consultation through voting link.

22nd law commission of India has initiated to solicit views and ideas of concerned stakeholders or public at large religious organisations. Law commission of india has generated a link where concerned stakeholders can fill up the generated form and can express their views over Uniform civil code.

Time period issued by the law commission is for 30 days commencing from 14.06.23 to 14.07.23.
